ELL Holdings, LLC, doing business as Elegance at the Cellular Level ("ELL," "we," "us," or "our"), operates this store and website, including all related information, content, features, tools, products, and services (the "Services"). This Privacy Policy describes how we collect, use, and disclose your personal information when you visit or use the Services, register an account, make a purchase, or otherwise communicate with us. Our store is powered by Shopify, which enables us to provide the Services to you. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using the Services you acknowledge that you have read it and understand the collection, use, and disclosure of information it describes.

Personal information we collect or process

When we use the term "personal information" we mean information that identifies or can reasonably be linked to you. Depending on how you interact with the Services and where you live, we may collect or process:

  • Contact details — your name, business or practice name, billing address, shipping address, phone number, and email address.
  • Professional and account-verification information — the information you submit when you register as a provider or partner, which may include your professional license type and number, state(s) of licensure, NPI, practice or business identifiers, and any documentation you upload, along with our record of the verification steps taken and their outcome.
  • Account information — username, password, preferences, and settings.
  • Financial information — payment card and financial account information, transaction details, form of payment, and payment confirmations. Card details are collected and processed by our payment processors; we do not store full card numbers.
  • Transaction information — items you view, add to your cart, purchase, return, or cancel, and your order history.
  • Communications with us — the content of your emails, support inquiries, product complaints, and any adverse event report you submit.
  • Device and usage information — device, browser, and network information, IP address, other unique identifiers, and information about how you navigate and interact with the Services, collected through cookies and similar technologies.
  • Marketing preferences — your email and SMS consent status and the record of when and how it was given or withdrawn.

Please do not send us health information about yourself or about a patient or client unless it is necessary to report an adverse event or product complaint. If you do report one, we will process the information you provide for safety, recordkeeping, investigation, and regulatory reporting purposes.

Where the information comes from

  • Directly from you — when you register, place an order, submit verification documentation, or contact us.
  • Automatically through the Services — from your device and browser, including through cookies and similar technologies.
  • From our service providers — including our commerce platform, payment processors, carriers, and customer relationship and marketing platforms.
  • From verification sources — publicly available professional registries and state licensing board records, used to confirm the credentials you submit.

How we use your personal information

  • Providing the Services. To create and manage your account, verify eligibility to purchase, process payments, fulfill and ship orders, arrange cold-chain delivery, handle claims and cancellations, provide order notifications, and maintain our business relationship with you.
  • Safety, quality, and regulatory compliance. To investigate product complaints, maintain adverse-event records, conduct traceability and recall activities, and meet recordkeeping and reporting obligations that apply to us.
  • Communicating with you. To respond to inquiries, provide support, and send transactional messages about your account and orders.
  • Marketing and advertising. To send marketing and promotional messages by email or SMS where you have consented or as otherwise permitted by law, and to show you online advertising. You can opt out at any time (see below).
  • Security and fraud prevention. To authenticate accounts, secure the Services, and detect and investigate fraudulent, unlawful, or malicious activity.
  • Legal reasons. To comply with applicable law and valid legal process, to respond to requests from government or regulatory authorities, and to establish, exercise, or defend legal claims.

How we disclose personal information

We do not sell your personal information for money. We may disclose it in the following circumstances:

  • Shopify — our commerce platform, which hosts the Services and processes information about your access to and use of them in order to provide and improve the Services.
  • GoHighLevel — the customer relationship management and marketing platform we use. Contact details, order information, communication history, and email/SMS consent status are shared with and stored in GoHighLevel so we can manage our relationship with you and send transactional and (where consented) marketing messages.
  • Payment processors — to authorize, process, and reconcile payments and to help prevent fraud.
  • Shipping carriers and cold-chain fulfillment providers — to pack, ship, and deliver your order, provide tracking, and handle customs where applicable. For international shipments, information required for customs clearance is provided to carriers and customs authorities.
  • Other service providers — including IT and hosting, data analytics, email delivery, customer support, and professional advisors, who process information on our behalf under contract.
  • Credential verification sources — where we submit or check information against professional registries or licensing boards.
  • Legal and corporate — to comply with law or legal process, to enforce our terms, to protect our rights and the rights of others, and in connection with a merger, financing, acquisition, bankruptcy, or sale of assets.
  • With your direction or consent — where you ask us to share information with a third party.

Marketing communications and SMS

You can unsubscribe from marketing email at any time using the unsubscribe link in any marketing message or by emailing us. If you have consented to SMS messages, you can stop them by replying STOP to any message or by contacting us; reply HELP for assistance. Message and data rates may apply, and message frequency varies. Consent to marketing messages is not a condition of purchase. We may still send you non-promotional messages about your account, orders, shipments, and product safety.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. To learn more about how Shopify uses your personal information and any rights you may have, see the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights through the Shopify Privacy Portal.

Cookies and similar technologies

We and our service providers use cookies, pixels, and similar technologies to operate the Services, remember your preferences, measure performance, and support marketing and advertising. Most browsers let you block or delete cookies, though doing so may affect how the Services function. Where required, we present a cookie or consent banner and honor the choices you make in it, including the Global Privacy Control signal where we are able to detect it.

Third-party websites and links

The Services may link to websites or platforms operated by third parties. We do not control and are not responsible for their privacy or security practices. Review their policies before providing information.

Children's data

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in your jurisdiction. If you believe a child has provided us information, contact us and we will delete it. We do not knowingly sell or share the personal information of individuals under 16 years of age.

Security and retention

We use administrative, technical, and physical safeguards designed to protect personal information, but no method of transmission or storage is perfectly secure and we cannot guarantee absolute security. Please do not use unsecured channels to send us sensitive or confidential information. We retain personal information for as long as needed to provide the Services and for our legitimate business purposes, and longer where a legal, tax, safety, quality, or recordkeeping obligation requires it — for example, verification records and adverse-event records are retained for the period applicable law requires.

Your rights and choices

Depending on where you live, you may have some or all of the following rights. These rights are not absolute, apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

  • Access / know — request access to the personal information we hold about you.
  • Delete — request deletion of personal information we maintain about you.
  • Correct — request correction of inaccurate personal information.
  • Portability — request a copy of your personal information, and in certain cases that we transfer it to a third party.
  • Opt out of targeted advertising, "sale," or "sharing" — where applicable privacy laws give you that right.
  • Manage communication preferences — opt out of marketing email and SMS at any time.

If you reside in the UK or the European Economic Area, you may also have the right to object to or request restriction of certain processing, and to withdraw consent where we rely on consent (withdrawal does not affect the lawfulness of processing before withdrawal).

To exercise a right, email info@ellstemcells.com with "Privacy Request" in the subject line. We may need to verify your identity before acting, and you may use an authorized agent if you provide proof of authorization. We will not discriminate against you for exercising these rights, and we will respond within the time applicable law requires.

Complaints and appeals

If you have a complaint about how we process your personal information, contact us at info@ellstemcells.com. Depending on where you live you may have the right to appeal our decision by contacting us again, or to lodge a complaint with your local data protection authority. In the EEA, a list of supervisory authorities is available from the European Data Protection Board.

International transfers

We may transfer, store, and process your personal information outside the country in which you live, including in the United States. Where we transfer personal information out of the European Economic Area or the United Kingdom, we rely on a recognized transfer mechanism such as the European Commission's Standard Contractual Clauses or the UK equivalent, unless the destination has been determined to provide an adequate level of protection.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will post the revised policy here, update the "Last updated" date, and provide notice where required by law.
